PHONE SMITHS TERMS AND CONDITIONS
Guarantee
PHONE SMITHS Service Guarantee means the unit to be repaired as specified upon book in. This covers the repair for the same defect as specified for a period of 90 days from date of collection/ delivery. This guarantee period of 90 days is only effective for the exact same fault or result of repair or service not including any further damages caused.
All repairs to liquid damage units are repaired primarily for data retrieval purposes only as progressive corrosion can occur over time.
PHONE SMITHS does not provide a guarantee for non genuine parts or components (fitted housings) supplied by the customers or third party.
A service fee may apply in the event that after a quote approval the customer / dealer wish to have the repair / service cancelled or reversed.
Customer Data
We advise customers / dealers to inform us of or deactivate all security codes, pin codes and locks prior to booking the unit in.
It is the customers / dealers responsibility for all SIM cards and memory cards to be kept secure and noted in relevant paperwork upon book in.
We also advise customers to back up all relevant data where possible and or clearly state in writing what user data may need to be recovered, backed up and restored.
All customers’ personal information is kept confidential and controlled by customer direction. No data or contact details are shared with any third party at any time.
Customers / dealers need to be aware that not all user data can be recovered.
PHONE SMITHS accept no responsibility for the loss of customer data. This includes customer contact details, phone numbers, custom phone settings, any media form and messages. As part of the test procedure, repair process and unlocking service, customer’s user data may be lost during this process. Where ever possible, customers will be given prior notice in written or verbal form.
Over Due Units
I/We agree that all units (mobile phones and accessories) will be held for a period of 14 days after the issue of a quote. A final notice will be issued following 14 days if quote is unanswered. After this period if no response has been received then units may be returned. Following a period of 90 days, handset may be recycled at our discretion.
PHONE SMITHS will hold completed repairs for a period of 60 days. After this period if units remain uncollected, I/We acknowledge that the goods shall become the property of PHONE SMITHS, and without limiting to the rights of PHONE SMITHS, the units may be recycled, disassembled, resold, repaired or disposed of in any manner PHONE SMITHS see fit.
I/We agree to indemnify PHONE SMITHS against damages or loss of data, (including consequential loss) during the disposal process of my/ our uncollected units beyond 60 days from notification of completion. I/We forfeit any entitlement to monies made from the unit’s resale after this period. I/We waive and discharge all claims made against PHONE SMITHS for any losses or damages regarding the uncollected units issued for repair/ service beyond 60 days of notification.
I/We accept that handsets booked in for repairs which require major component changes (BGA microchips etc) run the risk of failure, rendering the phone unusable. I/We agree that we have received a sufficient explanation of the quoted repair process and do not hold PHONE SMITHS responsible for any un-repairable faults. I/We accept PHONE SMITHS diagnosis Beyond Economical Repair (BER) as a conclusive diagnosis.
In the unlikely event that the booked in unit should become lost, (lost in transit under PHONE SMITHS control, stolen, damaged due to fire or natural disaster) PHONE SMITHS will refund the cost of the handset based on current prices and handsets condition when handset was booked in.
